These 3 case show the sorry state of the Indian judicial system……..the law enforcement and the judiciary r blaming each other……..and I feel that both of them have valid points
The judiciary say that the police has done a very crape job……the 3 cases r very high profile and the father of the accused is either a highly ranked police officer or a minister……and they could have influenced the investigation……they r highly influential people so its easy 4 them to alter reports…….they have the money and that power to buy off doctors and police officers…..and since enough proof was not submitted in the court, even though the judge knew that the culprit was rite in frnt of him he could not do anything but set them free.
On the other hand the police have said that they had done the best they could under the circumstances. According to them the case was lost cause of the prosecution……in most of these cases the govt is the prosecution…..ie its govt versus the defendant………i.e. a public prosecution is used……..According to the police these public prosecutors r now match 4 the pvt defiance that the guilty hire…….Usually the defendant r very rich and powerful……..they have enough money to get the best defense team in India………where as the victims have to depend of the less efficient public prosecutors. It’s a no match………the xpensive defense lawyers r too gud 4 the poor public prosecutors. Hence due to the inefficiency of the prosecution the case won’t be proven in court
Both of they might be rite. India must take steps to prevent such things frm happening…….Indian law enforcement must be much more strict……confidentiality and autonomy of the law enforcements must be maintained at all costs…….the investigations should be transparent and they people should be paid enough so that v can avoid corruption to a certain xtend…….nothing can be perfect but steps should be taken such that the law enforcement agencies r at least so what near to being perfect
Abt the judiciary………regular amendments should be made to the judiciary……the situation that prevailed during the time the judiciary was made is not that current situation. Stricter laws should be made so that rules r not broken often and if they r broken the guilty r punished accordingly…… In these 3 cases the respective judges and the whole nation knows who has done the crime but cant do anything abt it cause of lack of evidence and hostile witness…..so strict punishments should also be give to people who retract their statements
V should try to follow the type of system the Americans follows……..In America when some 1 is arrested frm that moment onwards anything he says can be produced against him in the court of law……so the suspects cant just retract their statements……here whatever u say when u r arrested doesn’t matter unless a magistrate is present when u r giving the statements…….In 1 of the cases there was a confession and they when he came to court he retracted
Something should be done abt the speed with which trials r heard…….people should not be made to wait 4 a long time to get the justice they deserve…….the defense should not be allowed to waste time unnecessarily and witnesses should be provided with enough protection…..to get justice in ur favour u must have really gud advocates…….and to get gud advocates u have to pay a lot………and that’s not possible 4 the poor victims……..nothings gonna change until people stop doing things just 4 the money……a few lawyers must take such cases so that they could help nailing criminals……..something like social service…….there is nothing rong with making money………along with making money v should give something back to the society……so unless gud advocates take up these cases the guilty will be set free……..or the govt or some cooperates or NGO’s or the normal people can help the victims by donating money so that they can get a gud lawyer or they can lend their support any way possible………. After these cases people of India have lost faith in their judicial system……where the rich who r guilty r set free and the poor who r innocent r put behind bars…….I am not saying that this happens in all the cases……but justice is not given in India in the rite way……it’s a very long process………it take ages 4 a case to come up in court 4 hearing…….and the defense can delay the case 4 a long time……..these days the mistakes authorities r doing r corrected only when there is a national uproar……and this is happening too many times 4 comfort…….its always better if it doesn’t come to this….mistakes should be corrected as soon as possible and not when the whole nation is ready to erupt. It shows the power of the citizens of India but it also shows the weakness of the Indian authorities…….the govt or any authority can be said to be successful when no 1 talks abt them……..so the authorities should make sure that they get least amount of publicity and do they job properly.
Rite now the 3 families r fighting 4 justice and I think I as responsible citizens of India v should join them and give all the support v can…..v can sign online petitions 4 the re-trial of the cases……v could give signed petition along with the prosecution to the court 4 the retrial……or v could just pray 4 the families to get justice………remember that there could be more such cases going on in India….and if v fite 4 justice now…….v can make sure that people wont think that they could commit a crime and get away just by influencing some people……..V must make they know that the people of India wont rest until justice is served.
